Ashland has an exciting opportunity for a Global Trade Compliance Specialist to join our Supply Chain business at our Ashland India, Mumbai, Maharashtra. This is a very visible, significant role within the Company and the Supply Chain function. This position will report to Manager.

As the Global Trade Compliance Specialist, you will be responsible for continual review and interpretation of regulatory requirements to manage import-export compliance and assist in assurance that the import and export activities are executed in compliance with all applicable laws and regulations. 

This role is also accountable for taking necessary steps to ensure that all levels of the organization are aware of Ashland's commitment to comply with all government regulatory requirements and act as the liaison to the organization on matters related to import-export compliance.  The individual hired will work on a global team with peers in four other countries, who collaborate to support Ashland’s global trade compliance around the world.

The responsibilities of the position include, but are not limited to, the following:

  • Responsible for HS Classification for new materials, extended materials and samples, and manage GTS HS code entry
  • Responsible for reclassification according to tariff changes for each country, review HS classification and manage classification changes
  • Work as a member of Global Classification Council to address HS classification disputes, discuss complex classification and manage changes
  • Responsible for material qualification for FTA and conduct compliance review annually
  • Be responsible for determination of country of origin and system maintenance
  • Address Customs inquiries (classification, price, COO, etc.) and Customs audits and serve as liaison with Customs for India and other south Asia countries as assigned.
  • Audit on import entries and export declarations and report with findings, work with the team for root cause analysis and corrective actions
  • Provide trainings to the organization on regulation, programs, procedures and trade compliance related topics
  • Understand import / export requirements for the countries supported (India and other South Asia countries)  and provide expertise for any import and export compliance related questions, solve compliance issues and work on improvements for identified gaps
  • Monitor regulation developments, interpretate the regulatory requirements, evaluate the impact, recommend the actions/changes/process required and communicate effectively
  • Support the import and export process and establish, standardize or improve the process to eliminate risks and ensure compliance
  • Manage duty condition for accruals with Ashland’s ERP system
  • Evaluate the license/registration requirement related to trade compliance for new business, maintain and support the application for required licenses as identified
  • Daily support to supply chain, commercial unit inquiries
  • Identify benefits/duty savings opportunities through tariff strategies, utilization of FTA and other trade programs/policies and maintain the program
  • Support monitoring of Ashland GTS system for compliance blocks, SPL, legal control, and sanctions as needed
  • Global Duty designee to gather and report upon Duty savings and spend globally Support other global or regional initiatives and projects as required or assigned

This position will drive trade compliance excellence across India Commercial / Functions/ COE's and /shared service as defined by adherence to applicable U.S., non-U.S. and local Customs and Export Control laws and regulations pertaining to international trade and exports as well as ensuring compliance with Thermo Fisher Scientific corporate, divisional and local policies. This individual will develop and implement training and qualification programs in partnership with the Corporate GTC Team including attendance at the Corporate GTC Team workshops for all import/export personnel in scope.
This position will support all India and OSA ( Nepal, Bhutan, Bangladesh, Srilanka, Maldives) sites in scope in developing efficient, effective and appropriate work procedures to support compliance and local global trade compliance management systems. The position will also provide advisory and support from legal standpoint working within the Legal Department for the country.
The Trade Compliance Manager must be able to successfully lead group projects with members and stake holders from a variety of functions and areas. There are a wide variety of activities involved in this position requiring excellent organizational skills and the ability to work and manage in a high energy, fast paced environment. A high degree of flexibility with the ability to respond to changing priorities is important. The ability to work independently and communicate effectively is a requirement.
**Essential Duties and Responsibilities:**
+ Collaborate with Corporate GTC Team and local resources, including Senior Management, Commercial, Manufacturing Operations, Logistics, Finance, Legal, Supply Chain etc., to drive strategic direction of trade compliance processes to ensure robust and proactive compliance management that meets current requirements of all countries and regions with which business is being conducted.
+ Technical competence required to make and certify calculations related to Country of Origin, Make in India Class, Local content percentage etc. for manufacturing and Assembly Lines in India. Advise Commercial teams on complex regularoy environments and advising on legitimate routes of sourcing and imports.
+ Customs competence required to identify and classify products under HSN categories and support deal with regulatory bodies on substantiating and establishing the HSN classifications.
+ Participate in regular meetings/trainings with the Corporate GTC Team and funnel down any communications and/or training to the relevant personnel within the region and communicate any issues requiring escalation to the Corporate GTC Team.
+ Work with the Corporate GTC Team to implement companywide initiatives relating to GTC, e.g. the Global Trade Compliance Management System (GTCMS) and any automated GTC tools or systems implementations.
+ Act as GTC expert and keep abreast on local laws and regulations , develop a GTC Compliance program for all Business Divisions in India and develop SOP's guidelines and controls. Provide leadership and training to all businesses with transactions to or from India and South Asia.
+ Understand and address all US and local Indian export control laws and regulations that pertain to the businesses operating in the country
+ Work within the Country to identify and implement short term and long-term strategic cost savings strategies, e.g. FTA, tariff engineering, etc.
+ Raise the overall level of knowledge and professionalism of import and export resources and leadership across the country and leverage best practices available from other Thermo Fisher programs.
+ Develop and implement method to communicate trade compliance performance for sites and functions in the country.
+ Ability to develop and conduct regular global trade compliance trainings across businesses and functions is required.
+ Support sites in internal assessments, desk audits, completion of post audit follow-up actions and evaluate common themes in audits and develop programs to proactively address issues across sites in the Country
+ Manage regional level standards and processes including customer screening, import and export classification processes, compliance documentation, and listing of controlled products.
+ Drive continuous process improvements to maximize customer delivery, quality, operational excellence and financial benefits associated with corporate standards and industry best practices.
+ Mitigate risk to the organization through proactive process management ensuring that all activities are carried out in accordance with Thermo Fisher Scientific policies, standards, and applicable laws in the area of import and export compliance.
+ Support Head legal on legal documentation, review agreements, support business partners and work as an advisory on legal and compliance related matters from time to time
**Minimum Experience and Skills Required**
+ Bachelor's Law degree Law, Business Management, or International Trade, or an equivalent combination of university education
+ Work experience - 8-10 years experience in Trade compliance management with demonstrated experience managing compliance activities in a multi-national company, Legal experience will be added advantage
+ Must be proficient in the local language and English.

The BU Analyst serves as a trusted advisor and key team member within TE’s Operational Compliance team for the BU. The purpose of this role is to facilitate TE’s compliance, at the BU level, with import and export regulations globally to enhance global trade compliance, reduce risk, increase responsiveness to issues and opportunities, and support effective operational aspects of international trade. 
This role reports into the GTS Manager EMEA (based in UK) and is a key member of the Global Trade Services (GTS) team. Job Responsibilities:

Trade Compliance Activities in the BU

  • Execute trade operations and provide compliance oversight for the assigned BU to ensure TE’s compliance with import/export laws and regulations in UK, US & Indian SCOMET Export Controls
  • Maintain trade operations and compliance activities in accordance with TE policies, procedures, and controls, in collaboration with key stakeholders throughout the BU
  • Act as a point of contact for BU stakeholders on trade-related matters.
  • Work with BU stakeholders and counsel to understand business changes and develop trade-related solutions/strategies and controls to ensure compliance
  • Maintain BU-level Key Performance Indicators (KPIs) and reporting to ensure efficiency and effectiveness of the operation

  • Collaborate with Corporate GTC Team and local resources, including Senior Management, Commercial, Manufacturing Operations, Logistics, Finance, Legal, Supply Chain etc., to drive strategic direction of trade compliance processes to ensure robust and proactive compliance management that meets current requirements of all countries and regions with which business is being conducted.
  • Technical competence required to make and certify calculations related to Country of Origin, Make in India Class, Local content percentage etc. for manufacturing and Assembly Lines in India. Advise Commercial teams on complex regularoy environments and advising on legitimate routes of sourcing and imports.
  • Customs competence required to identify and classify products under HSN categories and support deal with regulatory bodies on substantiating and establishing the HSN classifications.
  • Participate in regular meetings/trainings with the Corporate GTC Team and funnel down any communications and/or training to the relevant personnel within the region and communicate any issues requiring escalation to the Corporate GTC Team.
  • Work with the Corporate GTC Team to implement companywide initiatives relating to GTC, the Global Trade Compliance Management System (GTCMS) and any automated GTC tools or systems implementations.
  • Act as GTC expert and keep abreast on local laws and regulations , develop a GTC Compliance program for all Business Divisions in India and develop SOP’s guidelines and controls. Provide leadership and training to all businesses with transactions to or from India and South Asia.
  • Understand and address all US and local Indian export control laws and regulations that pertain to the businesses operating in the country
  • Work within the Country to identify and implement short term and long-term strategic cost savings strategies, FTA, tariff engineering, etc.
  • Raise the overall level of knowledge and professionalism of import and export resources and leadership across the country and leverage best practices available from other Thermo Fisher programs.
  • Develop and implement method to communicate trade compliance performance for sites and functions in the country.
  • Ability to develop and conduct regular global trade compliance trainings across businesses and functions is required.
  • Support sites in internal assessments, desk audits, completion of post audit follow-up actions and evaluate common themes in audits and develop programs to proactively address issues across sites in the Country
  • Manage regional level standards and processes including customer screening, import and export classification processes, compliance documentation, and listing of controlled products.
  • Drive continuous process improvements to maximize customer delivery, quality, operational excellence and financial benefits associated with corporate standards and industry best practices.
  • Mitigate risk to the organization through proactive process management ensuring that all activities are carried out in accordance with Thermo Fisher Scientific policies, standards, and applicable laws in the area of import and export compliance.
  • Support Head legal on legal documentation, review agreements, support business partners and work as an advisory on legal and compliance related matters from time to time
  • Minimum Experience and Skills Required

  • Bachelor’s Law degree Law, Business Management, or International Trade, or an equivalent combination of university education
  • Work experience - 8-10 years experience in Trade compliance management with demonstrated experience managing compliance activities in a multi-national company, Legal experience will be added advantage 
  • Must be proficient in the local language and English.
  • Ability to travel up to 20%

    How you will contribute
