- Managing all local and regional lawyers- standard legal report formats, payments, liasoning title discussions etc. Periodic lawyer visits across region, sharing new challenges and processes.
- Initiate all legal reports to lawyers and arranging reports from panel lawyers across the region.
- Initiation of property valuations and report arrangements for properties.
- Vetting all original legal documents and signing legal documents confirming in order.
- Proficiency in legal recovery- Filing Sec 138 and CERSEI cases
Responsibilities
1. Exceptions pertaining to property titles, missing documents, laminated papers, and other title checks to be given.
2. Liasioning with customers and intra departments for legal reports.
3. Standard formats of Indemnity bond, Affidavits to be made as required.
4. Managing storage of lawyer and vendor agreements.
5. Assist recovery team regarding property checks and other legal recovery work.
6. Registered mortgage (if any) will be done by legal representative.
7. Annual monitoring / Compliance/ RBI requirements pertaining to property and other regulatory frameworks.
8. Draft and solidify agreements, contracts and other legal documents to ensure the company’s full legal rights
9. Maintenance of tracker showing updated case status for each and every legal case for the company
10. In charge of filing civil/criminal complaint against customers, dealers, agencies, etc with due consultation with head of department.
11. Attendance of regular court hearings in various court-Filing of Sec 138 and CERSEI cases
Skills
- Should have sound legal knowledge on Code of Civil Procedure; Code of Criminal Procedure; Indian Penal Code; Companies Act; Insolvency and Bankruptcy Code, 2016 (IBC); SARFAESI Act, 2002; Transfer Of Property Act; Consumer Laws, Laws relating to mortgage lending (Negotiable Instruments Act, Payments & Settlement Act, Arbitration, Mediation etc.)
- Should have knowledge with respect to lending, mortgage, real estate, Securitization, charge creation etc.
